Local Tickets Terms and Conditions of Use – Ticket Purchasers

These Terms and Conditions of Use ("Terms") govern your use of our website ("Site") and form a binding contractual agreement between you (the ticket purchaser), the user of the Site and us, Local Tickets Pty Ltd ("Local Tickets").

For that reason these Terms are important and you should ensure that you read them carefully and contact us with any questions before you use the Site. You can contact us at info@localtickets.net.au. If you do not agree to the Terms, please do not use the Site.

1 Agreement

1.1 By using the Site you acknowledge and agree that:

(a) You have had sufficient chance to read and understand the Terms and you agree to be bound by them.

(b) Any breach of these Terms may lead to termination of these Terms and further action, including legal proceedings.

1.2 Local Tickets reserve the right to amend the Terms at their complete discretion from time to time. When the Terms are amended a notice will be placed on the front page of the Site. You agree to review the Terms from time to time. If you use the Site after Local Tickets have amended the Terms and placed a notice on the Site, you are agreeing to be bound by the amended Terms. If you do not agree to be bound by the Terms subsequent to future amendments you should promptly notify Local Tickets and discontinue your use of the Site.

2 Licence to use Site

2.1 We grant you a non-exclusive, non-transferable licence to use the Site in accordance with the Terms.

2.2 You may access and use the Site (including any incidental copying that occurs as part of that use) in the normal manner and may also print one copy of any page within the Site for your own personal, non-commercial use.

2.3 You must not add any content to the Site:

(a) Unless you hold all necessary rights, licences and consents to do so;

(b) That would cause you or us to breach any law, regulation, rule, code or other legal obligation;

(c) that is or could reasonably be considered to be obscene, inappropriate, defamatory, disparaging, indecent, seditious, offensive, pornographic, threatening, abusive, liable to incite racial hatred, discriminatory, blasphemous, in breach of confidence or in breach of privacy;

(d) that would bring us, or the Site, into disrepute; or

(e) That infringes the intellectual property or other rights of any person.

2.4 The Site contains links to other websites as well as content added by people other than us. We do not endorse, sponsor or approve any such user generated content or any content available on any linked website.

2.5 You acknowledge and agree that:

(a) We retain complete editorial control over the Site and may alter, amend or cease the operation of the Site at any time in our sole discretion; and

(b) The Site will not operate on a continuous basis, and may be unavailable from time to time (including for maintenance purposes) and Local Tickets may at its discretion suspend or terminate the operation of the Site;

(c) Local Tickets provides no commitment, warranty or guarantee that the Site will operate in a timely, uninterrupted or error-free manner or that the Site will meet your purposes.

3 Conditions of Sale and Purchase

3.1 All tickets are sold by Local Tickets as agent only for the Event Host. Any claims arising from purchase of tickets are solely against the Event Host. Local Tickets is not responsible for any aspect of any event promoted on the Site.

3.2 All tickets are sold subject to these Terms and the terms and conditions of the Event Host. You agree that you must make your own inquiries to ascertain the Event Hosts terms and conditions.

3.3 Tickets are only valid when purchased through the Site and photo ID may be required upon entry to the event.

3.4 By purchasing a ticket through our website, you are agreeing that Local Tickets Pty Ltd (or our regional brand) can use your email address and or mobile phone number to send you monthly newsletters and special invitations by email and or SMS.  At any time, you have the option to not receive any promotional information from us by opting out of the newsletter or replying to an SMS requesting no information.  Your data will not be sold to a third party. No credit card information is ever kept by us on file. (please refer to the NAB merchant facility terms and conditions).

3.5 Local Tickets may disclose your contact details to venues and promoters to advise of upcoming events, promotions and special offers.

4 Replacement, Refund and Resale

4.1 Refunds will be issued by Local Tickets Pty Ltd (unless a special agreement/guarantee is in place with the Event Host) if the event is cancelled before the scheduled start date and time for any reason including inclement weather, or reasons beyond the event hosts control such as severe weather, flood, fire, explosion, civil disobedience, riot, labour disturbances, war, sabotage or other acts of God.

4.2 If the event is rescheduled, Local Tickets Pty Ltd reserves the right to decide whether ticket holders will automatically be refunded, or whether tickets will be transferred to another date with a refund option.

4.3 The Booking, Service and Merchant Fees (if applicable)  are non-refundable to the fullest extent permitted by law.

4.4 Local Tickets reserves the right to decline to provide replacement tickets or alternatively charge a fee for replacement of tickets.

4.5 Tickets that are resold or assigned may not be honoured. Tickets resold for a premium, or used for advertising, promotion or any commercial purpose without the written consent of Local Tickets and the Event Host will be cancelled without refund and the bearer refused admission.

5 Payment

5.1 All payments made on the Site are by way of an internet SSL secure payment system sourced from a third party (NAB). You must refer to the terms and conditions of the third party for particulars regarding the transaction.

5.2 Local Tickets is an Australian Owned business and all prices displayed are in Australian Dollars (AUD) only.

5.3 All prices are inclusive of GST, where applicable, unless otherwise stated. You will be provided with a receipt /tax invoice for payments automatically.

5.4 If paying by credit card a Merchant Fee is payable by the Ticket Purchaser, which is in addition to the event Ticket Price and payable at the time of merchant processing.

5.5 A Service Fee of $1.00 will be payable on each transaction by the Ticket Purchaser.

5.6 Cash sales tickets incur the Ticket Fee but not the Merchant Fee.

5.7 The Booking Fee is payable by the Ticket Purchaser to Local Tickets.

5.8 The Ticket Price is payable by the Ticket Purchaser to the Event Host and will be received by Local Tickets as agent only for the Event Host.

6 Privacy

6.1 This Privacy Policy applies to all personal information collected by Local Tickets Pty Ltd ("Local Tickets") via the Site.

Collection and Purpose

6.3 Local Tickets may collect personal information from you in the course of your use of the Site if you input any personal information into the website. In addition, we also collect cookies from your computer, which enables us to tell when you use the website and also to help customise your website experience.

6.4 The purpose for which we collect personal information is to provide you with the best service experience possible on the website. Some provision of personal information is optional. However, if you do not accurately provide us with certain types of personal information, you may be unable to enjoy the full functionality of the website or receive the service you have requested.

6.5 Event Hosts and Ticket Purchasers may receive emails relating to their events and purchases or relating to other events on the Site.

Retention of Information

6.6 Local Tickets may retain your personal information for a period up to 7 years to comply with legislative requirements with respect to record keeping.

6.7 Where Local Tickets are no longer required or authorised by law to retain your personal information it will be destroyed or permanently de-identified.

6.8 Local Tickets comply with the Payment Card Industry Data Security Standards (PCI-DSS) so do not retain or store any credit card information.

 Disclosure

6.8 Local Tickets will use the personal information you provide to provide you with the service you have requested and will not disclose any of your personal information to a third party except where:

(a) You consent to the disclosure;

(b) It is necessary to provide you with the services you have requested, as determined by Local Tickets;

(c) A Court, law or regulation requires that the personal information be disclosed, including with respect to the investigation or reporting of suspected unlawful activity;

(d) The Local Tickets Terms and Conditions provide that the personal information will be disclosed;

(e) Disclosure of your personal information is necessary to prevent or reduce a serious risk to health or safety, as determined by Local Tickets.

6.9 Local Tickets may provide statistical information about the services and users of the Site to third parties, however all personally identifiable information will be removed.

Access and Correction

6.10 National Privacy Principle 6 of the Australian Privacy Act allows you to get access to, and correct, the personal information we hold about you in certain circumstances. If you would like to obtain such access, please contact us on the details set out above.

Security

6.11 We have processes in place to ensure the security of your personal information, including encryption of all data when it is transferred to our service providers and limitations on access to personal information within our organisation.

6.12 The Site may contain links to other websites that are not controlled or owned by Local Tickets. Local Tickets provides no commitment, warranty or guarantee with respect to the security and privacy practices of such websites.

7 Intellectual Property Rights

7.1 Nothing in these Terms constitutes a transfer of any intellectual property rights. You acknowledge and agree that, as between you and us, we own all content and intellectual property rights in the Site.

7.2 You acknowledge that any use of any part of the Site will be an infringement of Local Tickets intellectual property rights.

7.3 By posting or adding any content onto the Site, you retain any intellectual property rights you may have in the content and grant us a perpetual, non-exclusive, royalty-free, irrevocable, worldwide and transferable right and licence to use that content in any way (including, without limitation, by reproducing, changing, and communicating the content to the public) and permit us to authorise any other person to do the same thing.

7.4 You consent to any act or omission which would otherwise constitute an infringement of your moral rights, and if you add any content in which any third party has moral rights, you must also ensure that the third party also consents in the same manner.

7.5 The licence in clause 7.3 will survive any termination of these Terms.

7.6 You represent and warrant to us that you have all necessary rights to grant the licences and consents set out in clauses 7.3 and 7.4.

8 Warranties

8.1 You represent and warrant to us that:

(f) You have the legal capacity to enter these Terms; and

(g) You have complied with clause 2.3.

9 Liability

9.1 To the full extent permitted by law, we exclude all liability for any direct, indirect, incidental or consequential damages, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from your access to, use of, inability to access or reliance on the Site or its content.

9.2 Local Tickets does not guarantee the accuracy of information, or the suitability of events promoted, or anything else on the Site. You agree that you must make your own enquiries as to the accuracy of information provided on the site, including but not limited to information about any event promoted by an Event Host.

9.3 To the full extent permitted by law, we exclude all representations, warranties or terms (whether express or implied) other than those expressly set out in these Terms.

9.4 Ticket Purchasers purchase tickets and attend events at their own risk and Local Tickets will not be liable for any personal or professional injuries, damage or other direct or indirect loss resulting from your attendance at an event.

10 General

10.1 You must not assign, sublicense or otherwise deal in any other way with any of your rights under these Terms.

10.2 These Terms do not designate Local Tickets, you or any other party as the agent, employee, legal representative, partner or joint venture of any party for any purpose whatsoever.

10.3 If a provision of these Terms are invalid or unenforceable it is to be read down or severed to the extent necessary without affecting the validity or enforceability of the remaining provisions.

10.4 The failure of Local Tickets, you or any other party to exercise any right provided in these Terms shall not be deemed a waiver or forfeiture of any such right.

10.5 Each party must at its own expense do everything reasonably necessary to give full effect to these Terms.

10.6 All Terms relating to payment, disclaimers, and limitations of liability, confidentiality and proprietary right shall survive termination.

10.7 This Agreement is governed by the laws of Queensland and each party submits to the jurisdiction of the courts of Queensland.

1 Agreement

3 Use of site by Event Host

3.1 The Event Host is permitted to use the Site in accordance with these Terms to promote an event/events.

3.2 Local Tickets agree to act as agent for the Event Host to provide an online ticket booking service for the Event Host's event in accordance with and to the extent of these Terms only.

3.4 The Event Host agrees that:

(a) Local Tickets will receive the Ticket Price in full as agent for the Event Host.

(b) The Event Host will pay the Per Sold Ticket Fee to Local Tickets for each ticket sold.

(c) Local Tickets are entitled to retain the Per Ticket Sold Fee from the Ticket Price and any other costs associated with the event eg refunds, marketing tools, advertising costs, scanner hire, in satisfaction of the amounts owed to Local Tickets pursuant to clause 3.4(b).

 (d) Local Tickets will transfer the Ticket Price, minus the Per Ticket Sold Fee and any other associated costs relating to the event, to the nominated account of the Event Host 3 - 5 days after the event.

 (e) In circumstances where Local Tickets are required to pay any amounts as a result of a chargeback, the Event Host is liable to Local Tickets with respect to the full amount of any chargeback and any associated costs and bank fees.

(f) Local Tickets is entitled to charge the Ticket Purchaser the Booking Fee.

(g) Local Tickets is entitled to charge the Ticket Purchaser a Service Fee on each transaction.

(h) Local Tickets is entitled to charge the Event Host $1.00 per ticket for contra tickets

(i) Local Tickets is entitled to charge the Event Host $1.00 per person for use of the rsvp facility.

(j)  Local Tickets Pty Ltd reserves the right to suspend the sale of tickets for an event on our site at any time without prior warning.

4 Event Host Terms and Conditions

4.1 The Event Hosts may use the Event Host Terms and Conditions provided by Local Tickets or upload their own terms and conditions.

4.2 Event Hosts use the Event Host Terms and Conditions at their own risk and must make all enquiries necessary to satisfy themselves of the legality and suitability of the Event Host Terms and Conditions for the intended use.

4.3 Local Tickets provides no commitment, warranty or guarantee that the Event Host Terms and Conditions are suitable for any use.

4.4 Local Tickets accepts no responsibility for any direct, indirect, incidental or consequential damages howsoever arising resulting from the use of the Event Host Terms and Conditions.


5 Conditions of Sale and Purchase
5.1 All tickets are sold by Local Tickets as agent only for the Event Host. Any claims arising from purchase of tickets are solely against the Event Host. Local Tickets is not responsible for any aspect of any event promoted on the Site.

5.2 Local Tickets is an Australian Owned business and all prices displayed are in Australian Dollars (AUD) only.

5.3 All tickets are sold subject to these Terms and the terms and conditions of the Event Host. The Ticket Purchaser must make the Ticket Purchaser's own inquiries to ascertain the Event Hosts terms and conditions.

5.4 Tickets are only valid when purchased through the Site and photo ID may be required upon entry to the event.

5.5 Local Tickets may disclose the Ticket Purchaser's contact details to venues and promoters to advise of upcoming events, promotions and special offers.

6 Replacement, Refund and Resale

6.1 Local Tickets will only refund to the Event Host at their discretion and minus any associated costs, eg individual ticketing refund costs, marketing tools purchased, advertising fees and any costs associated with the use and hire of the QR scanners. A $100.00 refund processing fee will apply and will only be considered if an event is cancelled, rescheduled, or if the major drawcard is cancelled. These considerations will only be made prior to the event being held. 

6.2 The Booking, Service and Merchant Fees are non-refundable to the fullest extent permitted by law.

6.3 Local Tickets reserves the right to decline to provide replacement tickets or alternatively charge a fee for replacement of tickets.

6.4 Tickets that are resold or assigned may not be honoured. Tickets resold for a premium, or used for advertising, promotion or any commercial purpose without the written consent of Local Tickets and the Event Host will be cancelled without refund and the bearer refused admission.

6.5 Local Tickets will at their discretion refund the use of any equipment supplied by Local Tickets.

  7 Payment

7.1 All payments made on the Site are by way of an internet SSL secure payment system sourced from a third party (NAB).

You must refer to the terms and conditions of the third party for particulars regarding the transaction.

7.2 All prices are inclusive of GST, where applicable, unless otherwise stated. You will be provided with a Statement of Account /Tax Invoice for payments automatically.

7.3 The Booking Fee is payable by the Ticket Purchaser, which is in addition to the event Ticket Price and payable at the time of merchant processing.

7.4 A Service Fee of $1.00 will be payable on each transaction by the Ticket Purchaser.

7.5 Cash Sales tickets only incur the Ticket Fee but not the Merchant Fee.

7.6 The Booking Fee is payable by the Ticket Purchaser to Local Tickets.

7.7 The Ticket Price is payable by the Ticket Purchaser to the Event Host and will be received by Local Tickets as agent only for the Event Host.

8 Privacy

11.2 Local Tickets does not guarantee the accuracy of information, or the suitability of events promoted, or anything else on the Site. You agree that you must make your own enquiries as to the accuracy of information provided on the site, including but not limited to information about any event promoted by an Event Host.

11.4 Ticket Purchasers purchase tickets and attend events at their own risk and Local Tickets will not be liable for any personal or professional injuries, damage or other direct or indirect loss resulting from your attendance at an event.
